A South Carolina couple is asking an Oklahoma man and the Cherokee Nation to pay for expenses in connection with the couple's adoption of a Cherokee girl.

The Tulsa Worldreports the petition was filed Sept. 9 in South Carolina by Matt and Melanie Capobianco while Dusten Brown was appealing court orders to hand over his 4-year-old daughter Veronica.

Brown is the biological father and fought for custody after the child was adopted by the couple.

The Capobiancos took custody of the girl Monday after the Oklahoma Supreme Court refused to assume jurisdiction.

Attorneys for Brown and the tribe declined comment because of a gag order.

The Capobiancos didn't ask for a specific amount, but want Brown and the tribe reimburse the couple for attorneys' fees and other expenses.
