Appeals Court Upholds Conviction In Child Murder Case

The Oklahoma Court of Criminal Appeals

The Oklahoma Court of Criminal Appeals says it won't reverse the second-degree murder conviction of a man charged in the 2012 death of his 14-month-old son in Bryan County.

Jurors rejected a first-degree murder charge against Marin Clay Allison on Oct. 2, 2013, but convicted him of a lesser offense and recommended a 19-year prison term. Allison appealed, saying the judge should have barred testimony from a doctor unable to attend the trial.

The court, sitting in Oklahoma City, said Wednesday the doctor's testimony only backed up other evidence and didn't contribute to the verdict.

Durant police said Ethan Allison died from a traumatic brain injury. Jurors faulted Marin Allison for failing to seek prompt medical attention for the child, accepting his argument that the boy was injured accidentally.
